Terms for companies
Version 1.0 · Last updated 14 October 2026
1. Parties and scope
These Terms apply between Futura Human Resources, operated by Davide Ferrario (NIF 336609620, R LAGOA BUSINESS CENTER - RUA CORONEL FIGUEIREDO LOJA 5, 8400-306 LAGOA, Portugal), and the business named in the company account ("Company"). They govern the use of the company area of futurahumanresources.com. The service is offered to businesses only, not to consumers.
2. The service
Futura provides: publication of job ads on futurahumanresources.com; a company area to receive and manage applications; search among candidate profiles that candidates have chosen to make visible; and an "Invite to apply" function. Futura does not select, recommend or pre-screen candidates: the Company carries out every assessment and hiring decision. Futura is not a party to any employment contract and does not act as employer, recruitment agency or placement agency. Futura does not guarantee the number or quality of applications, or any hire.
3. Access, packages and fees
Futura creates the company account after the package has been agreed in writing (email is enough). The package sets the access period ("access until") and the maximum number of active job ads. Fees are paid in advance by bank transfer; access starts once payment is received. Prices exclude VAT; invoices are issued under Portuguese rules, with reverse charge where it applies. When access expires, the Company can still view and manage the applications it has received, change their status and close positions, but cannot publish ads, search candidates or send invitations. Fees are not refundable, except where required by law or agreed in writing.
4. Job ads
The Company is responsible for the content of its ads and for their legal compliance. Every ad must: describe a real, current vacancy accurately (role, location, contract type); not discriminate on grounds such as age, sex, gender, racial or ethnic origin, religion or belief, disability, sexual orientation or nationality, except where a genuine and lawful occupational requirement exists; comply with applicable labour, immigration and pay transparency rules; and never ask candidates to pay a fee, buy anything or provide payment details. Futura approves ads before publication and may reject, correct obvious errors in, suspend or close ads that breach these Terms. Ads expire after the period set at approval (30 days by default) and can be renewed.
5. Candidate data
The Company receives personal data when candidates apply to its ads, and can view visible profiles in candidate search. For this data the Company acts as an independent controller under the GDPR and is responsible for processing it lawfully, informing candidates where required, keeping it secure and deleting it when no longer needed. The Company:
- uses candidate data only to assess and contact candidates for genuine job opportunities, never for marketing, resale or disclosure to third parties other than its own service providers;
- does not scrape, bulk-download or access the platform with automated tools, and does not try to obtain the contact details of candidates who have not applied, other than through "Invite to apply";
- does not use age, nationality, photos or other protected characteristics to take unlawful decisions;
- informs Futura without undue delay of any security incident involving data obtained through Futura;
- keeps application statuses up to date and closes positions once filled, so that candidates are informed automatically.
6. Account security
The Company keeps its login details confidential, is responsible for all activity on its account and informs Futura immediately of any unauthorised use.
7. Suspension and termination
Futura may suspend or terminate access in case of breach of these Terms, unlawful or misleading ads, misuse of candidate data or non-payment. The Company may stop using the service at any time.
8. Liability
Neither party is liable for indirect or consequential losses. Futura's total liability is limited to the fees paid by the Company in the 12 months before the claim. The Company indemnifies Futura against third-party claims arising from its ads, its hiring decisions or its use of candidate data. Nothing in these Terms excludes liability that cannot be excluded by law.
9. Changes
Futura may update these Terms. The new version is published with its date and must be accepted at the next login.
10. Law and jurisdiction
These Terms are governed by Portuguese law. Any disputes shall be submitted to the competent courts in accordance with applicable law, without prejudice to any mandatory consumer rights concerning jurisdiction.
